Clara Miller Matter


Clara Miller holds a judgement against USCL Corporation and Tom D. Tamarkin personally in the approximate amount of $150,000.

Clara Miller is a USCL shareholder. She never loaned or advanced USCL or Tom Tamarkin any funds. However, as a result of the Jack L Mador, Miller USCL settlement she assumed Jack Mador’s claim against USCL resulting from the June 2002 settlement plus interest. At the time of the USCL Mador Miller settlement, USCL gave Clara Miller a promissory note personally guaranteed by Tom Tamarkin.

The USCL Mador Miller Settlement is discussed in the Jack L Mador Matter discussion. This settlement was negotiated in good faith by all parties. At the time USCL was working on a large $50 million USD bond offering which it believed would close and USCL’s plan was to pay Mrs. Miller from the proceeds of the bond transaction.

However for reasons discussed in the “USCL Corporation capitalization from Inception through 2011” section of the USCL and EnergyCite due diligence website section the bond was not funded.

Subsequently USCL defaulted on the Miller promissory note. Mrs. Miller engaged the legal services of Kirk S. Rimmer, ESQ., to file a lawsuit against USCL and Tom Tamarkin. The lawsuit was uncontested by the defendants and Mrs. Miller was awarded her claims for monies owed plus legal fees and a judgment against USCL and Tom Tamarkin was filed.

For the record, Kirk S. Rimmer has been the personal attorney of Jack L. Mador who Mrs. Miller alleged misappropriated $425,000 of cash funds from the miller’s as stated in the letter from Pillsbury Winthrop to Mr. and Mrs. Mador dated October 9, 2007.
